Terms of Use

1. Acceptance

These Terms of Use ("Terms") are an agreement between you and MAIN OÜ, an Estonian private limited company (registry code 11272196), registered at Soosepa tee 46-2, Pärnamäe küla, Viimsi vald, Harju maakond, 74020, Estonia ("we", "us"), governing your use of the DashCam - FREE application for iOS ("the App"). By downloading or using the App you accept these Terms. If you do not accept them, do not use the App.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, redistribute, sell, rent, sublicense, reverse-engineer, decompile, or attempt to derive the source code of the App, except to the extent that applicable law expressly prohibits such a restriction. We reserve all rights not expressly granted here; the App and all intellectual property in it remain ours.

3. What the App does

The App records video (and, if you allow it, audio) using your device's camera and stores the resulting files locally on your device. It has no server component: recordings are not uploaded, backed up, or transmitted to us. See our privacy policy for detail. We may change, improve, or discontinue features in future versions.

4. Your content and your responsibilities

Recordings you make are yours. You are solely responsible for them and for how you use them, including compliance with the laws of the place where you drive. In particular:

• Dash cam and recording law varies by country and region. Some jurisdictions restrict filming in public, require notice before recording audio, limit windscreen-mounted devices, or regulate what you may publish. It is your responsibility to know and follow the rules that apply to you.
• Other people appear in your footage. If you share or publish recordings, you may take on obligations of your own under data-protection or privacy law.
• You must not use the App to harass, stalk, or unlawfully surveil anyone.

5. Safety

Do not operate your device while driving. Mount your device securely, in a position that does not obstruct your view or interfere with airbags or vehicle controls, and start recording before you set off. You remain fully responsible for safe and lawful operation of your vehicle at all times. We are not responsible for accidents, injuries, fines, or damage arising from use of a device while driving.

6. No guarantee of recording or of evidential value

The App is a consumer utility, not a certified incident recorder. Recording can be interrupted or lost for reasons outside our control - a full or failing storage device, a low battery, thermal shutdown, an incoming call or system interruption, an iOS update, a crash, or the device being knocked out of position. We do not warrant that any particular moment will be recorded, retained, or usable, and we make no representation that a recording will be admissible or persuasive as evidence in any proceeding, insurance claim, or dispute. Check that recording is working, and export anything important promptly.

7. DashCam Pro subscriptions

The App is free to download and the recording features are free to use. DashCam Pro is an optional auto-renewing subscription. Any features it covers are identified as such in the app at the time you subscribe.

• Title and length. DashCam Pro (Monthly), a 1-month subscription, and DashCam Pro (Annual), a 1-year subscription.
• Price. $0.99 per month or $6.99 per year in the United States. Local prices are shown in the App before you purchase and may differ by country and with taxes.
• Free trial. A 7-day free trial is offered to eligible new subscribers. If you have used a trial in this subscription group before, you are not eligible again. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Payment. Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial period.
• Auto-renewal. The subscription renews automatically at the same price unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the period.
• Managing and cancelling. You can manage your subscription and turn off auto-renewal at any time in your Apple Account settings after purchase. Cancelling stops future renewals; your subscription remains active until the end of the period you have already paid for. Deleting the App does not cancel a subscription.
• Restoring. Use "Restore Purchases" in the App to re-apply an existing subscription on a new or reset device signed in to the same Apple Account.

8. Refunds

All purchases are made through Apple, and refunds are handled by Apple, not by us, under the App Store Terms of Service. We cannot issue, approve, or reverse a charge. To request a refund, use Apple's Report a Problem page or contact Apple Support. Any mandatory statutory refund or withdrawal right you have under consumer law is unaffected by this section.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device or iOS version. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, MAIN OÜ is not liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost recordings, lost data, lost profits, or costs arising from an accident, claim, dispute, or prosecution in which a recording was absent, incomplete, or unusable. Our total aggregate liability arising out of or relating to the App is limited to the amount you paid us for it in the twelve months before the claim - which, for a free download, is zero. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

11. Apple

These Terms are between you and MAIN OÜ only - not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product-liability, regulatory, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

12. Termination

These Terms apply for as long as you use the App. You may end them at any time by deleting the App (remember to cancel any subscription separately through Apple). We may suspend or terminate your licence if you materially breach these Terms. Sections 6, 9, 10, and 11 survive termination.

13. Governing law

These Terms are governed by the laws of the Republic of Estonia, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.

14. Changes and contact

We may update these Terms as the App evolves; the "last updated" date above reflects the current version, and continuing to use the App after an update means you accept the revised Terms. Questions? Reach us via our support page.
